The conditions of availability and use of the entity.


Please read the conditions carefully and pay attention to these elements:

Simply put, we want DAYPRISE to remain an entertainment platform and a social network where everyone (users) feel safe.

To do this, help us maintain a platform where life is good.

Post only your own videos, photos and music, and always respect the law.

We ask you to respect everyone on Dayprise, and we will remove any content that contains hate speech or credible threats, content that targets specific individuals in order to humiliate or dishonor them, personal information used for blackmail or harassment, and repetitive junk mail.

 

We will never encourage or attack violence against anyone because of their skin colour, ethnic origin, nationality, sex, gender, gender identity, sexual orientation, religious affiliation, disability or medical condition.

Do not post undesirable content such as spam, misinformation, violent content, nude images or video ...

 

Remember that by using Dayprise, you agree to follow these rules and our terms of use.

Compliance with these rules is important to us and we hope that it is equally important to you. Because we will uncompromising with the unwanted content, be aware that their violation will result in the deletion of the content immediately after multiple checks, but also a temporary or permanent ban of the account in question, but this can also lead to more severe sanctions.

Because even if this undesirable content is shared with good intentions, it could be used or misinterpreted by others that users may not think of .

1. YOUR ACCOUNT

1.1) Can I create an account and use DAYPRISE?

Yes, but you must be an adult or be at least 13 years old and have the permission of your parents or legal guardian.

If you are not an adult, an emancipated minor or if you do not understand this article, please speak and ask for help from your parents or legal guardian.

If you are the parent or the legal guardian of a minor who creates an account with us, you and the minor agree to be bound by these Terms. You are also responsible for any use of the account and the minor's compliance with these Terms.

1.2) Do I have to indicate my real name, first name, date of birth etc.?

Yes, you must always provide us with accurate, complete and the up-to-date information, for example to enable us to unlock your birthday videos on the right date. 

1.3) Can I share or sell my account or my login credentials?

No, when you create an account, we ask you for personal and private information such as “Login Credentials” which you will use each time you access to our platform.

So, you agree to the following:


You cannot share your account or login credentials with anyone.

You may not sell, transfer or allow anyone to access or offer to access your account or Login credentials.

You must preserve the confidentiality of your Login credentials.

You must notify us immediately if you become aware of security breach, including any unauthorised access to your account or any unauthorised loss, theft, use or disclosure of you Login credentials, so that we can take appropriate action.

You are responsible of all losses on your account when you have shared your login IDs or you have not sufficiently secured your account or your Login IDs.

1.4) How can my account be suspended or deleted?

  • -  If you do not respect the rules of the community. We may terminate or suspend your account without notice, if we reasonably determine that you have breached our terms of use.

  • -  Otherwise you can terminate or suspend your account at any time by contacting us at account@dayprise.com.

  • -  If we have stopped offering DAYPRISE in your country, you can transfer your account to another region near to yours.

 

1.5) Will DAYPRISE keep my account indefinitely, even if I stop using it?

If your account remains abandoned for an extended period, we can terminate it after notifying you in advance by email, in this case we will also delete all of your personal data.

You understand and agree that the use of DAYPRISE services involves the risk that your account will be terminated or suspended in accordance with these Terms, and that you must take this risk into account and always behave appropriately when using it.

1.6) What should I do when I cannot connect to my account?

First of all, we invite you to check your internet connection, you can try to go to the link of our website (dayprise.com).

After That:

  • -  Check if the version of the application you are using is the latest that we

    have distributed.

  • -  Check the Status of the DAYPRISE server in your region in our website at

    the bottom of the page (dayprise.com).

  • -  Check that you are using the correct email address.

  • -  Check your password.

    If after all these attempts, you still cannot log in we invite you to reset your password directly in the login section of the application, we invite you to always use a strong password with at least 8 characters including a special + a number and at least one capital letter.

  • If after resetting your password or if you do not succeed in this step, we invite you to contact the support service directly at support@dayprise.com or directly via the contact form on our website.

 

1.7) How do I change the email address of my account?

You understand now that we are currently using a system where you cannot manually change your email address, and this for secutrity reasons, in case you have lost access to your mail and you wish to change the email address we invite you to contact us directly at: account@dayprise.com

1.8) How can I retrieve all my account information?

You just have to write us directly at the address: account@dayprise.com mentioning that you wish to recover certain information or content linked to your account.

BY USING OUR SERVICES, YOU AGREE THAT IN ADDITION : You will not create more than one account for yourself.

You will not create another account if we have already deactivated or banned your account, unless you have our permission to do so.

You will never share your password.

You will not connect or attempt to access the Services through a third party, some applications or clients not authorized by Dayprise. 

DATA COSTS AND MOBILE PHONES

You are solely responsible for any mobile charges you may incur for the use of our services, including data charges. Because Dayprise like any online platform uses remote servers to send data to your smartphones. 

If you are unsure of these charges, you should contact your service provider directly before using our Services.

 
2. INTELLECTUAL PROPERTY

You probably know this, but you should only share photos and videos or music that you have taken, created or have the right to share.

Undoubtedly, any content that you decide to publish on Dayprise belongs to you and you are responsible for it. 

You must publish content that belongs to you or for which you have permission to distribute, and especially do not publish any content that you have copied or downloaded via the internet and on which you do not have the necessary rights for publication. 

If you have any doubts and want to know more about intellectual property rights, here is a subject that could enlighten you, so I invite you to consult it. 

Intellectual property is the domain comprising all the exclusive rights granted on intellectual creations.

DAYPRISE is committed to helping individuals businesses and protect their intellectual property rights. DAYPRISE'S Terms of Use do not permit the publication of content that infringes the intellectual property rights of others, including copyright and trademarks.

We encourage you to create authentic and unique content.

To help us fight against boosted or fake content, we will never encourage you to collect "Like" or "Share" mentions if they come from fake or artificial accounts.

Do not publish repetitive contents either, it pollutes the platform and it is useless, do not contact or publish anything to people for commercial purposes without their consent or ours, we have a commercial section for companies, you can directly consult it or contact us by email at business@dayprise.com .

In order to fight against disinformation and false accounts, we will ask you for accurate and regularly updated information.

It is clearly forbidden to impersonate any person and do not create accounts with the aim of breaking our rules or deceiving other Internet users, this would lead to an immediate ban.

We are working hard to be a honest company and so, you must also respect the law. 

Terrorism, organized crime or hate groups have no place on DAYPRISE, nor does sexual content involving minors or threats to post intimate images of others, we will have zero tolerance for such accounts or postings, and we will do  everything we can monitor such activity on our platform.

We also remind you that the basic concept of DAYPRISE is not an online store, so it is strictly forbidden to trade via our platform in any way whatsoever.

It is also clearly prohibited to offer sexual services, firearms, alcohol and tobacco products. The purchase and sale of drugs and medicines is prohibited even if this activity is legal where you are, our platform is not here for that.

 
3. CONTENT

Help us fight unwanted content on DAYPRISE.

Remember that each member of the DAYPRISE community is an individual in his or her own right.

So, if you see content that appears to be in violation of our policies, please let us know using our integrated reporting system.

We have a content monitoring system, but we also have an international team that reviews each report and works hard to remove any content that does not comply with our rules as quickly as possible. 

When submitting a report, try to provide as much information as possible, such as links, usernames and descriptions of the content, so that we can find and review the content as quickly and accurately as possible. 

We may remove certain posts or events completely if we find that the images or associated captions break our rules.

Security and integrity of information

The security of your personal information and the integrity of our systems is important to us and we treat your data with our partners as assets to be protected against loss and unauthorized access.

We employ digital and physical security techniques to protect your personal information, including, where appropriate data encryption,  scalable system implementation.

Please note, however, that no security can meet all of the anticipated or unforeseen IT security needs.

Collection, use and disclosure of information

DAYPRISE will never use or disclose your personal data or the data in which it collects without obtaining your prior consent, except as provided in this policy.

The personal information you provide when you use our platform is strictly confidential, we do not submit any data to third parties unless otherwise stated in this policy.

Rights you grant us

Many of our services allow you to create, publish, send, receive and store content. When you do this, you retain all ownership rights of that content.

But you grant us a worldwide and unlimited license to use this content.

For all Public & Private content that you submit via our services, you grant DAYPRISE a worldwide royalty-free, sublicensable and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, and distribute such content.

The purpose of this license is to exploit, develop, provide, promote and enhance the services and to research and develop, create derivative works from, promote, exhibit, disseminate, publicly perform and publicly display content in any form and in any media or methods of distribution (now known or hereafter developed). To extent necessary, when you appear, create, publish or submit Content. 

Because public content is inherently public and chronicles issues of public interest, the license you grant us for this content is broader.

to the extent necessary, when you appear, DAYPRISE has the unlimited, worldwide and perpetual rights and license to use your name, image, videos, edits, events including in connection with commercial or sponsored content. This means, among other things that you will not be no entitled to any compensation from DAYPRISE, if your name, image, videos, clips , events are conveyed through our Services, either on the DAYPRISE application or website either on other platforms.

Our Services may contain advertisements. In consideration for DAYPRISE, granting you access to and use of the Services, you agree that we, our affiliates and our third party partners may place advertisements on the Services. Because the Services contain content that you and others users provide to us, advertising may sometimes appear in close proximity to your content.

We always like to hear from our users. But, if you provide comments or suggestions, just know that we can use it without compensating you and without any restrictions or obligations to you.

The content of others

Much of the content in our services is produced by platform users, publishers and other third parties.

Whether this content is published publicly or sent privately, the content is the sole responsibility of the person or organization that submitted it.


Although DAYPRISE, reserves the right to review or remove all content that appears on our platform, or data centers and we do not necessarily review everything. As a result, some content may appear on our platform without authorization.

We therefore cannot and do not take the responsibility for the content that others provide via our Services.

With these conditions and our community guidelines, we make it clear that we do not want our services to be misused.

But because we do not review all content, we cannot guarantee that the content of our Services, or the use of our Services by our users, will always comply with our DAYPRISE Terms or Guidelines, but we do our best to keep our platform a safe and enjoyable place.

Modification of our services and termination

We are constantly improving our services and creating new things all the time on DAYPRISE.

This means that we may add or remove features, products or functionality and we may also suspend or discontinue the Services altogether.

We can take any of these actions at any time and when we do, we may not notify you in advance.

Although, we hope that you will remain on DAYPRISE indefinitely, you may terminate these Terms at any time and for any reason by requesting deletion of your account.

DAYPRISE may also terminate these Terms with you at any time for any reason and without notice. This means that we may stop providing you with Services, or impose new or additional limits on your ability to use our Services.

 

It is your responsibility to periodically review these Terms of Use to see if any changes have been made to it.

 
4. LIMITED LICENSE

You may use the DAYPRISE Services for personal, non-commercial use (or make a request at business@dayprise.com).


We grant you a limited, non-exclusive, non-assignable and revocable license to use the DAYPRISE Services, if we terminate your account, the licenses of using DAYPRISE Services and Virtual content will terminate immediately. Unless, expressly authorized to the contrary in writing by us in a contract, you do not have the right to sell, copy, exchange, lend, carry out a reverse engineering act, decompile, derive the source code, translate, rent, grant security, transfer, publish, assign or otherwise distribute DAYPRISE Services or DAYPRISE intellectual property including any computer code or virtual content.

 
Other Request

Each request that you make by email will be assigned a file number and appropriate support until the problem is resolved as soon as possible.

Please, note that each file remains open for a maximum 14 calendar days. If you do not receive a response from us or from you within this period, our system will consider your file to be resolved, if this is not the case, I invite you to make a new request.
